At Newman, Aaronson, Vanaman Attorneys at Law, our goal is to protect the Long Beach rights of children with disabilities so that these children can live rich lives and grow into successful adults. In the United States, the rights of all individuals are protected by law, and this includes the rights of those children who may be physically, emotionally, or mentally disabled. Much of these children’s lives revolve around school because this takes up much of their day and because high-quality schooling is vital to helping these children reach their goals throughout life.
Understand Legal Rights for Long Beach Children with Special Needs
Long Beach children may be able to qualify for special services under IDEA if they undergo an evaluation and are approved by the school district. However, not all children with medical or psychiatric diagnoses will automatically qualify for these special services. Sometimes, parents work with us if their children have been denied special services. We can often help with independent evaluations and can help school districts work within the law to provide children with accommodations or modifications that they may need to succeed in school.
IDEA covers 13 main disability categories, some of which include the following:
- Emotional disturbances
- Intellectual disabilities
- Orthopedic impairments
- Speech impairments
- Traumatic brain injury
However, IDEA also makes it clear that the disability must make it difficult for the child to learn or progress in school. The school district has to prove that the child will need special education services in order to progress normally or at all.
